Police Station Agents & Firms which instruct them

1. What is CrimeDiary?
1.1. CrimeDiary is NOT a police station agency
1.2. CrimeDiary IS a central diary system for police station representatives “Reps” to advertise their availability to solicitors’ firms (“Firms”) who may be looking for Reps.
1.3. By accepting your registration for CrimeDiary and allowing you to advertise your availability on CrimeDiary we are not assuming any obligation to provide you with work.
1.4. The right to register is governed by and your entitlement to continue to advertise your availability is contingent on compliance with both
a) the CrimeDiary Principles; and
b) the CrimeDiary Code.

2. How does it work?

2.1. If your registration is accepted you will be provided with:-
a) a login to the CrimeDiary website – where you can add picture, profile and contact details for the purposes of marketing yourself to Firm; and
b) a login to the CrimeDiary calendar portal – where you can enter details of your availability in terms of time/date/location
2.2. Once you publish your availability on the CrimeDiary calendar, details will be provided on request to Firms seeking a Rep.  Firms will then contact you directly to organise attendance at the police station.
2.3. ALL contractual arrangements in relation to the police station attendance are to be conducted between the Rep and the Firm.
2.4. You do NOT make any payment to CrimeDiary in respect of the introduction
2.5. CrimeDiary is NOT responsible for the rates that Firms are prepared to pay (subject to the CrimeDiary Code) and is NOT responsible to you in any way for payment in respect of work you have undertaken for a Firm.

3. The CrimeDiary Principles
3.1. CrimeDiary is a service provided by solicitors, for solicitors.  All people and firms using CrimeDiary are expected to promote the principles that underpin the solicitors’ profession to include:
a) Dealing with integrity, honesty and professionalism at all times
b) Promoting quality in the services provided to clients
c) Championing equality and diversity and ensuring all registrations and/or allocations undertaken in the course of operating CrimeDiary are managed in a way which is free of any element of discrimination

4. The CrimeDiary Code
4.1. The CrimeDiary Code is a non-exhaustive list of indicative behaviours which would indicate compliance with the CrimeDiary Principles
4.2. In promoting integrity, honesty and professionalism:-
a) Firms will – be expected to pay a reasonable rate for police station attendances having regard to the market rate in any particular area
b) Firms will – be expected to pay Reps within a reasonable period
c) Reps will - be expected to faithfully represent the Firm that has instructed them and to ensure that any work arising from an instruction by a Firm is returned to that Firm
d) Reps will - have regard to the SRA Code of Conduct for Solicitors and, under no circumstances, will accept, make or facilitate payment of any sum to or from a client or Firm in respect of the referral of any criminal case.

4.3. In promoting quality of services provided to clients:-
a) Firms will – be expected to promptly report any failure by any Rep to act in accordance with the CrimeDiary Principles or CrimeDiary Code
b) Reps will – be expected to return paperwork promptly to Firms
c) Reps will – be expected to maintain their own accreditation and supervisory arrangements and notify CrimeDiary immediately if they are not entitled to represent clients at the police station for any reason.
d) Reps will – be expected to actually be available at the times of their published availability.  Reps will be removed from CrimeDiary if they are repeatedly unavailable for work at times where they have indicated availability
4.4. In promoting equality and diversity:-
a) Firms will – have no regard to any protected characteristics when considering whether or not to instruct a particular Rep (save in exceptional circumstances, where the facts of the case and/or nature of the client make it necessary to do so)
b) Reps will – be expected to represent ALL clients regardless of any protected characteristic that they may have (although will not be expected to put themselves at risk of any abuse or harm by virtue of any client’s intolerance).

5. CrimeDiary will and will not….
5.1. CrimeDiary WILL
a) promote the availability of all Reps to Firms as fairly and objectively as possible, but may respond to direct requests from Firms regarding availability of particular Reps (provided such requests are not made in breach of the CrimeDiary Principles or CrimeDiary Code).
b) provide online training with regards the use of the CrimeDiary
5.2. CrimeDiary WILL NOT
mediate or become involved in disputes in any way between Reps and Firms (it may remove any Rep or any Firm in circumstances where a dispute appears to have come about to any breach of the CrimeDiary Principles or CrimeDiary Code

Magistrates’ Court Advocates & Firms which instruct them

1. What is CrimeDiary?
1.1. CrimeDiary is NOT an agency
1.2. CrimeDiary IS a central diary system which enables firms and independent advocates to advertise their availability to provide advocacy services in the Magistrates Courts to solicitors’ firms (“Firms”) who may be looking for Magistrates’ Court advocates (“Mags Advocates”).
1.3. By accepting your registration for CrimeDiary and allowing you to advertise your availability on CrimeDiary we are not assuming any obligation to provide you with work. 
1.4. The right to register is governed by and your entitlement to continue to advertise your availability is contingent on compliance with both
a) the CrimeDiary Principles; and
b) the CrimeDiary Code.

2.1. If your registration as a Mags Advocate is accepted you will be provided with:-
a) a login to the CrimeDiary website – where you can add picture, profile and contact details for the purposes of marketing yourself to Firm; and
b) a login to the CrimeDiary calendar portal – where you can enter details of your availability in terms of time/date/location
2.2. Once you publish your availability on the CrimeDiary calendar, details will be provided on request to Firms seeking a Mags Advocate.  Firms will then contact you directly to organise attendance at the court.

a) Firms will – be expected to pay a reasonable rate for Magsitrates’ Court hearings having regard to the market rate in any particular area – (in London usually by reference to the informal London protocol and outside London usually by reference to legal aid rates).
b) Firms will – be expected to pay Mags Advocates within a reasonable period
c) Mags Advocates will - be expected to faithfully represent the Firm that has instructed them and to ensure that any work arising from an instruction by a Firm is returned to that Firm
d) Mags Advocates will - have regard to the SRA Code of Conduct for Solicitors and, under no circumstances, will accept, make or facilitate payment of any sum to or from a client or Firm in respect of the referral of any criminal case.

Higher Court Advocates & Firms which instruct them

1. What is CrimeDiary?
1.1. CrimeDiary is NOT an agency
1.2. CrimeDiary IS a central diary system which enables firms and independent advocates to advertise their availability to provide advocacy services in the Crown Courts to solicitors’ firms (“Firms”) who may be looking for Higher Court advocates (including solicitor Higher Court Advocate and Barristers) (“Higher Court Advocates”).
1.3. By accepting your registration for CrimeDiary and allowing you to advertise your availability on CrimeDiary we are not assuming any obligation to provide you with work. 
1.4. The right to register is governed by and your entitlement to continue to advertise your availability is contingent on compliance with both
a) the CrimeDiary Principles; and
b) the CrimeDiary Code.

a) a login to the CrimeDiary website – where you can add picture, profile and contact details for the purposes of marketing yourself to Firms; and

4. The CrimeDiary Code
4.1. The CrimeDiary Code is a non-exhaustive list of indicative behaviours which would indicate compliance with the CrimeDiary Principles
4.2. In promoting integrity, honesty and professionalism:-
a) Firms will – be expected to pay a reasonable rate for Crown Court hearings having regard to the market rate in any particular area – which would usually be the Advocates Graduated Fee payable in accordance with the Bar Protocol, subject to a reasonable for “clerking” services provided to the Higher Court Advocate; including
• Access to case management system/papers
• Support with listing issues
• Support with managing clashes in the Higher Court Advocates diary to facilitate their availability for any particular hearing
• Billing services – to include billing on conclusion of a matter and all dealings with the LAA in respect of submission, payment and appeal (if necessary).
b) Firms will – be expected to pay Higher Court Advocates within a reasonable period
c) Higher Court Advocates will - be expected to faithfully represent the Firm that has instructed them and to ensure that any work arising from an instruction by a Firm is returned to that Firm
d) Higher Court Advocates will - have regard to the SRA Code of Conduct for Solicitors or Bar Code of Conduct (as appropriate) and, under no circumstances, will accept, make or facilitate payment of any sum to or from a client or Firm in respect of the referral of any criminal case.

4.3. In promoting quality of services provided to clients:-
a) Firms will – be expected to promptly report any failure by any Higher Court Advocate to act in accordance with the CrimeDiary Principles or CrimeDiary Code
b) Higher Court Advocates will – be expected to return paperwork promptly to Firms
c) Higher Court Advocates will – be expected to maintain their own accreditation and supervisory arrangements and notify CrimeDiary immediately if they are not entitled to represent clients at court for any reason.
d) Higher Court Advocates will – be expected to actually be available at the times of their published availability and will be removed from CrimeDiary if they are repeatedly unavailable for work at times where they have indicated availability
